4. Products, Pricing & Availability

We make reasonable efforts to ensure product descriptions, images, and pricing on the Website are accurate at the time of publishing. However:

  • Colours and appearance may vary slightly from what is shown due to screen display differences.
  • We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information, at any time without prior notice.
  • All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless stated otherwise.
  • We reserve the right to refuse or cancel any order, including where a product is listed at an incorrect price due to a typographical or technical error, whether or not the order has been confirmed. If payment has already been taken for a cancelled order, you will receive a full refund.

5. Orders & Payment

Placing an order on the Website is an offer by you to purchase the relevant product(s). Receipt of an order confirmation email does not constitute our acceptance of your order — it confirms only that we have received it. A contract between you and EveryNook is formed only when we dispatch your order.

We accept payment via the methods displayed at checkout. You confirm that any payment details you provide are valid and that you are authorised to use the relevant payment method.

6. Shipping, Returns & Refunds

Shipping timeframes, costs, and delivery terms are set out in our Shipping Policy. Returns, exchanges, and refunds are governed by our Returns & Refunds Policy. Both policies are available on the Website and form part of these Terms.

7. Promotions & Discount Codes

From time to time we may offer promotions, discount codes, or bundle offers. Unless stated otherwise, promotional codes:

  • are valid for a limited time only and may be withdrawn or amended at our discretion;
  • cannot be combined with other offers unless expressly stated;
  • have no cash value and are not redeemable for cash;
  • are provided for personal use by the recipient and may not be resold, transferred, or shared for commercial purposes.

8. Fan Sleeve Applicator — Product in Development

The Fan Sleeve Applicator ("Applicator") is a product currently in development. As at the "Last updated" date of these Terms above, the Applicator has not yet been released and is not available for purchase.

Any mention of the Applicator on the Website, in advertising, or in customer communications (including a discount code offered in a post-purchase email following the purchase of another EveryNook product) is provided for information purposes only. It does not constitute an offer to sell the Applicator, and it does not create a pre-order, reservation, or purchase of the Applicator.

Where you are issued a discount code for the Applicator:

  • the discount itself is genuine and will be honoured against the advertised retail price of the Applicator at the time you choose to purchase it, once it becomes available;
  • no payment is taken from you for the Applicator at the time the code is issued, and issuing the code does not create a contract of sale for the Applicator;
  • the code may be subject to an expiry date and other conditions, which will be stated at the time it is issued;
  • receiving the code does not guarantee that the Applicator will be released by any particular date, in any particular form, or at all.

We are actively working towards bringing the Applicator to market. However, product development timelines, final specifications, pricing, and availability may change, and we reserve the right to modify, delay, or discontinue development of the Applicator at our sole discretion, without liability to you. As no payment is made for the Applicator unless and until it is purchased separately once released, EveryNook is not obligated to deliver, supply, or otherwise provide the Applicator to any customer.

Nothing in this clause limits your statutory rights under the Australian Consumer Law in relation to products you have actually purchased from us.

9. Your Rights Under the Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the ACL, including that they are of acceptable quality and fit for the purpose for which they are commonly supplied.

Where permitted by law, our liability for a breach of a non-excludable guarantee is limited, at our option, to one or more of the following: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired.

To the maximum extent permitted by law, and subject to Clause 9 above, EveryNook will not be liable for any indirect, incidental, or consequential loss arising from your use of the Website or your purchase of any product, including loss of profits, data, or opportunity.

We will not be liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from circumstances beyond our reasonable control, including natural disasters, supplier delays, courier or postal disruptions, or government restrictions.
